South Carolina Hands-Free Driving Law Now in Effect

COLUMBIA, S.C. — South Carolina drivers are now required to go hands-free behind the wheel as the state’s new distracted driving law officially took effect on Monday.

Gov. Henry McMaster signed the SC Hands-Free Act (H3276) in May, putting South Carolina in line with many states already enforcing stricter rules on cellphone use while driving.

What the Hands-Free Act Prohibits

The law bans drivers from holding a mobile device, texting, reading, or watching videos while operating a moving vehicle. Parked vehicles are exempt from the restrictions.

Drivers may still communicate using earpieces, wrist devices, or voice-activated commands, provided they do not physically hold their phones.

180-Day Warning Period

For the first six months, law enforcement officers will only issue warnings to drivers caught violating the rule. After this 180-day grace period, fines and license points will apply.

To raise awareness, signs are being placed at every interstate highway entrance across the state, reminding motorists about the new law.

Why the Law Was Passed

South Carolina continues to face one of the highest road death rates in the nation. Legislators hope the hands-free measure will reduce distracted driving accidents and fatalities.

The state had already banned texting while driving in 2014, but lawmakers say this expanded rule is a necessary step forward.

Regional Context

While South Carolina has moved ahead, North Carolina lawmakers introduced a similar bill in May but have not taken further action. Previous attempts there failed despite some success in the House.
